Camille2: Dear Visa Officer, I am a graduate student in a U.S. university. My family was refused once for B2 visa application in Beijing this year. We would like to apply for B2 visa again, and I read from the embassy website that visa application are not restrained even if the person has been refused once. However, I found there is no openning slot in Beijing for second time applications such as this, not even for people who were refused once in February or March 2008. Could you please help us with this? We are just hoping for a chance of family reunion during summer holidays, after August my family would have to go back to work and wouldn't be able to come here... Could you please help with this? Or give us some suggestions? Many thanks! Sincerely, Camille
Summer is our busiest season and the demand for visas to the U.S. is especially great this summer. We can only provide appointments for a certain number of people, based on the size of our waiting rooms and the number of visa officers we have. First priority for appointments is for students and business travelers. People who have
already been refused a visa do have to wait longer, in order to give other people a chance to apply. Visas are usually valid for one year, so we always encourage people to apply as early as possible. You could check again with the visa call center to see if your family can get an appointment, as we will be able to open a limited number of new appointments in July and August.

Answer: Whether or not you actually use a visa that you apply for is not important and will not have any impact on your future  2 applications. However, the visa officer might ask you why you did not use the visa. Your explanation is very reasonable.

peter2: Dear officer, Thank you for your time to read my question. The school I have applied is required by law to document students finance of about $16,000 for one year .The question is that if I need supply more money for getting a visa and how much it is.By the way,I have got $8,000 for scholarship each year. Best wishes Violin
The requirement for the visa is that the applicant must have all the money needed for their first year of study (according to the I20) at the time of the interview, and be able to show that they will have access to the money or a way to get the money that they need to complete the rest of the program.

Question:

> Dear visa officer: I have a question for you. Why business visas for Chinese enterprises to conduct business investigation are so difficult to get? My friend and I planned to conduct business visit in the US but our applications were rejected. We are lawful Chinese citizens; we have adequate financial resources to undertake the trip and legitimate reason to travel to the US. However, the consulate in Guangzhou rejected our applications without even taking a look at our materials. It that normal? My friend and I are legal persons and general managers. Will we abandon our business and families in China and illegally stay in the US? We have invitation letters from the US inviter and itinerary. I think it is unfair to Chinese enterprise since we need to conduct business investigation and invest there and pay taxes to the US government. I hope that you can understand our feeling. Thank you and sorry to bother you.

06-03-2008 02:07:32  3
ANSWER: I understand that it can be very frustrating for legitimate travelers to be refused a visa. The problem is that we see many applicants who are not legitimate travelers going to the U.S. for “business investigations.” Sometimes, these applicants are not employed where they say they are, or their invitation letters are fraudulent. If you feel that you are qualified for a visa under U.S. immigration law, you are welcome to reapply for a visa.

Chunjie: I work in ShenZhen, but my home in HeNan province. Can I get the VISA in GuangZhou Embassy?
We always recommend that people apply for a visa in the place where they regularly work and live, but where you apply is your decision.

> > Hi officer: I am a sophomore student and I will have my summer vacation in this July. I am so lucky that I got help from a couple from the US to be an intern in a hospital in the US. It is a great opportunity for me to learn more. After that I will return to my university to start the new semester. What else do I need to provide except invitation letter from the hospital and certificate from my university? Is the issuance rate for people like me high? Or I do not have a chance at all? Thanks!

06-03-2008 02:09:38
Answer: I am not sure I completely understand your situation. In order to do an “internship” in a U.S. hospital, you would have to go through a specific program that was authorized to run such a program and apply for the correct type of visa. Rules on non-U.S. citizens and students who want to learn more about hospitals are very strict. You can find the relevant section of U.S. immigration law that relates to medical students coming to the U.S. on the internet. I suggest you fully investigate the law before you apply. The hospital should be able to help you with that if they are running a legitimate program.

kposh2: Dear Sir or Madam, I want to apply for J1 vise.I wonder that the expiry date of my passport is Feb.2008, but the expiry date of my DS2019 form is Aug.2009. Should I change my passport for J1 visa?
It sounds like your passport has already expired. Your passport must be valid for at least six months from the time that you plan to enter the U.S or you will not be allowed to enter the country and will turned around at the airport. If your passport expired while you were in the U.S, you could apply for another one at the Chinese Consulate in the U.S. It would not matter that your visa was in your old passport, or that your visa expired, as long you keep the passport with the visa in it and of course, as long as you are still in your J1 program and your DS2019 is still valid.

sightview: I am a student who want to get an F-1 visa. My parents applied the immigrant visa on behalf of me 9 years ago when i was only 9 years old and i had no idea about it then. Now i have already been refused to get the F-1 visa and the visa officer didn't give me any chance to explain it.Actually i just want to study in the United States, not immigration. I have withdraw my immigrant visa and someone in the United States want to garentee that I will come my China after my graduation. Is that enough? What shall he do? Any certificates? or just write a letter with his signature? Thanks!
Someone else cannot guarantee that you will return to China; however, if someone wants to write a letter to support you that is fine (it should be in English). You need to explain to the visa officer why your parents applied for the immigrant visa, and when and why you withdrew your immigrant visa application. Also, you should explain where your parents are now, and what they are doing. You need to convince the visa officer that you do not plan to immigrate to the U.S. This will be harder for you than for other people, since your parents clearly wanted you to immigrate at some point. However, we understand that circumstances can change. You should be ready to explain this clearly and quickly at your next interview.

> I want to apply for an F-1 visa first. If I don't pass the interview, can I apply for a J-1 within a month? ANSWER: If you have been refused a visa before, there is generally a longer wait to get another appointment, however, students do have priority for visa appointments and can request an expedited appointment. To request an expedited appointment, follow the instructions on our website.

June2: Hello, this question is kind of emergency. I am studying in a College now, and I will back to China in June, and i also have to renew my VISA in this summer. My visa has expired for 6 months. Is the grade report must submitted? Do you have any requirement of the grade? what about if i took 4 courses, grades are: one A, one B, two C? what could happened in this situation? Could you give me some suggestion?
Yes, when you renew your visa, you must also submit your transcripts for all the time that you were in the U.S. studying. The visa officer needs to verify that you are still a full-time student.

> 我 97年曾經持 B1前往美國,并按時回國,過去幾年,我去過英國,德國,日本,都如期回國...
> 我在中國有相當體面的工作和不菲的收入...
> 我太太擁有自己的企業...

> 我在中國擁有更多的機會和上升空間,我為什么要持 B2簽證在美國逾期逗留???
> 如果 5年后才讓我踏上美國土地,卻不能見到母親的話,我是不會去的!!!
> My parents are all retired and they reside in the US. My mother cannot stand long distant travel because of her health condition. We have not met  6 with each other for 5 years! My wife and I applied for B2 visas today (May 23) and got rejected and I do not understand why. I traveled to the US in 1997 with a B-1 visa and I returned to China on time. I also traveled to other countries like Britain, Japan, Germany, etc and came back. I have a decent job with high income, my wife has her own enterprise, we have house, car and savings which exceed 3,000,000RMB. Our adorable daughter needs to stay in China because of her education. Why our applications were rejected? Is it only because my sister filed an immigration petition for me for which I have to wait for 5 years? Does that mean I will not be able to see my aged mother in 5 years? I have more opportunities in China, why do I stay in the US illegally with a B-2 visa? If I have to wait for 5 years to land on the US but cannot see my mother at that time, I will not go!!!

06-03-2008 02:16:09
ANSWER: According to U.S. immigration law, the visa officer cannot issue a visa to someone who is an intending immigrant. Since your sister has already filed an immigrant petition for you, it is very difficult to prove that you are not an intending immigrant. Legally, the visa officer can issue you a B2 (nonimmigrant visa) only if he or she is satisfied that you do not intend to immigrate to the U.S. and abandon your residence abroad. If you feel you can satisfy this requirement, you are welcome to reapply. Based on the situation you describe above, it sounds like you could meet the requirements, but only the visa officer who interviews you can determine whether or not you are qualified for a visa.

Bruce2: Hi, I have an actual question about my visas. I plan to US as a visiting scholar in a university in Nov. 1, 2008 (I think it needs a J-1 visa). But before my visiting, I have to attend a conference held in Honolulu, Oct. 12~18 (I think it needs a B-1 visa) and will to return to China right after the conference. So, since my two entrances to US are quite close, how could I apply for my visas? May I apply for two visas in a single interview? What can I do then? Thanks a lot and looking forward to your helpful reply.
This is a very good question. You could apply for the two visas at the same time, but, you can only apply for the J1 visa 120 days before your program starts. Also, you need to have your DS2019 before you can apply for the J visa. We always recommend that people apply for the visa as early as possible. It might be safer to apply for the B visa as soon as possible. You could always make another appointment to get the J1 visa after you get the B visa, even if you have not yet traveled on the B visa. People  7 going to the U.S. on J and F visa have priority for visa appointments. Keep in mind that it could take a month or more to process your visas.

> Hi. I am holding a Republic of China passport and I'm currently living in Beijing. I plan to take my son to have sightseeing in the US in 2009. I want to apply for a visa but I learned from your website that most of the visas are only valid for one year. (In Taiwan, visas are valid for five years with multiple entries). I do not know whether or not I should apply recently. If I only get a one-year visa, that visa will be expired before my date of departure in 2009. Please let me know the validity of a visa and most appropriate time for me to apply. Thank you. >

Answer: This is correct, visas for residents of the PRC are limited to 12 months. This is based on agreements between governments and cannot be changed by the visa officer. We suggest you apply a few months before you plan to travel.

Bruce2: Hi! I am a F1 student in America and I will go home this summer. I just finished the ESLI(English as Second Language International) program in my university, and I will be a freshman when I back from China in September. The case is I need to renew my Visa. The first thing I want to ask is I changed my major before I go to University, so my major is different from the major that appeared on the I-20 now, is that Ok? The second is I plan to use the drop-off service to renew my Visa, the grade I have is the ESLI's grade but not Univertsity's grade, and the grade is not the kind of official transcript, I want to know if it is acceptable. The third is if I will not use the drop-off service, I want to do the interview, need I prepare the Proof of Finances as before? Thank you very much.
Whether or not you use the drop-off service or come for the interview is up to you, but from what you describe, it sounds like it might be hard for the visa officer to understand your situation without talking directly to you. It would be better if you could show an official transcript, but if you cannot, perhaps you could ask your ESL program for a letter explaining  8 why you do not have an official transcript. If you changed your major, you should get a new I20, please ask your school for advice. You can bring both the old and new I20s to the interview. The officer will probably not ask for your proof of finances, but it cannot hurt to bring them.

chenshifei: Why is visa checking process taking so long right now? My wife has to delay her flight twice to wait for her visa. Thanks.
Summer is our busiest period. Special processing could be taking longer because there are many, many students from all over the world applying for visas that need special processing and this can slow down the process. If your wife has been waiting for more than two months, I suggest she send a fax with her information to the embassy or consulate where she applied. There could be a problem with her application, for example a missing document.

Ireland sky: I'm Mr.Yu Liang ,the organzier of China Pavilion for a trade show (July 15-17) in USA. My chinese exhibitors are going to have a visa-interview by the end June, but they are informed that the nearst interview should be on 20.July after the show. the questions are: 1, When should the exhibitors apply for a visa interview, 1 month before the show ? 2,do the exhibitors have any chance obtaining the early interview time, if they can't get the visa interview on time?
Summer is our busiest season and the wait for visa appointments can be longer than we would like. We always recommend that people apply for a visa as far in advance as possible. Business travelers can apply for an expedited appointment, but such appointments are not guaranteed. Please follow the instructions on our website for requesting an expedited appointment.

To request an expedited appointment, please follow the instructions on the website for the Embassy or consulate where you live.

> Your website says: “Effective May 1, 2007, applicants under 14 or over 80 years of age who would normally apply in Beijing can courier their nonimmigrant visa applications to the visa unit through China CITIC Bank, without the need to apply in person.
> Children under 14 are not required to come to the U.S. Embassy to apply for a nonimmigrant visa. If at least one parent holds a valid U.S. nonimmigrant visa, a child may apply through the courier service. If a parent or parents are applying for a visa at the same time as a child under 14, the parent(s) may bring in the child's application at the time of their interview and apply on the child's behalf.”
> However, it does not clearly say whether or not children of those who entered the US with valid visas and legally stay in the US with expired visas can use this drop off service.
> Like me, I entered the US in 2006. I currently study in the US with my F-1 status. My visa expired in January of 2007 but I am holding valid passport and I-20. My son is three and half years old. Can I submit my son’s application through CITIC Bank?

06-03-2008 02:23:37
Answer: Yes, your son can use the drop-off service because he is under 14. He is not required to have an interview or have his fingerprints taken. wang10: Dear Sonia, I am a single mother and divorced on Sep. 2003, My son is 10 years old, came to U.S.A. with me on May 2000 and went back to China on May 2001 because of my broken marriage. He has been raised by my parents since 2001.I currently hold a H-1 visa, my son's father got green card on Sep. 2005 and he didn't file any immigrant petition for his son these three years. I am trying to apply a H-4 visa for my son. Is it easy to get refused for this case?

Thank you very much. Sincerely yours, Wei Tan
As long as your son is under 18, and you have a valid H1 petition, your son is entitled to an H4 visa and there is no reason why he should be refused a visa if you entered the U.S. legally and you are currently in the U.S. legally. However, since he has not lived with you since 2001, you must be able to show the visa officer that he is your son. You should prepare his birth certificate, the passports that you and your son traveled on when you went to the U.S in 2000, copies of correspondence between you and him,
evidence that you support him, etc.

Tina2: Hello; I'm studying in Weston Oregon University of USA. I'm going back to China in summer break. My visa will be expired at Nov 29th,2008. I would like to renew it during my summer break in China. Because I would like to visit my fiance in TaiWan during Christmas 2008, then go back to USA. Is that ok to renew your visa even the visa hasn't expired yet. thanks~
Yes, you can renew it even though it has not expired. You should be able to use our drop off service, but you might want to include a letter that explains why you are renewing the visa early. Returning students should always have copies of their transcripts when applying to renew their visas.

Ruojia: Form DS 157 asks if the applicant has made specific travel arrangement. Is it a good idea to purchase flight ticket before an applicant was approved for his/her B2 visa?
No. You should never purchase an airplane ticket before receiving your visa. We always encourage people to apply for the visa as far in advance as possible, so you will still have time to purchase an airplane ticket. You should, however, have some plan for where you are going and where you will stay in the U.S. before your interview.

> Hi officer. If an American friend wants to sponsor me to have sightseeing in Alaska in this September, what documents does he need to prepare? Do you have any requirements for the invitation letter? Does he need to provide any certificate to prove that he can cover my expenditure? Where he can get these certificates? I myself do not have that much money or a stable job. My salary is not high. Do you think I can get a visa? Thank you. >
Answer: Under U.S. immigration law, an American citizen cannot “sponsor” someone to visit the U.S. An applicant must qualify for the visa herself by showing that she has strong ties her home and that she does not intend to immigrate to the U.S.

Franky2: I already finished my first year of master, still have another year, and I'm now back to China to see my parents, my visa will be expired until July 11st, but I will go back to the U.S on July 3rd, so do I need to apply for visa again in case I might want to come back next year? Thanks!
You can still use your current visa to enter the U.S., as long as you enter before the date that the visa expires. It is up to you whether or not you want to apply for another visa now, or next time you return from the U.S. Just keep in mind that it can take about one month to process a student visa, so you should apply when you have plenty of time to wait for the visa processing.

My husband has a colleague got three times refusal for this reason. Could you please suggest us how could we got the visa in this circumstance? Is this the side effection of sub-prime crisis? Thanks a lot!
I can assure you that there is no policy to refuse visas for people who work for financial institutions. I do not know why there is such a rumor right now, but it is certainly not based in reality. Visa policy is determined by the Immigration and Nationality Act and is not related to the economy

> My passport will expire in this September. I will go to the US pursue my PHD which lasts 5 years. Will my soon-expired passport have any negative impact on my application?

ANSWER: No. A visa only gives you permission to apply for entry to the U.S. at a port of entry (like an airport). The immigration officer at the border will determine how long you can stay in the U.S. For a student, that amount of time is called “duration of status.” That means, you can stay as long as your are a full-time student.

weiwei2: Urgent: My F-1 visa(1 year duration, M entries) will expire in Sep, 2008. Last year, due to the admistrative process, when I received my visa, I had missed the starting date of my graduate program. The same school deferred my scholarship and this year, I plan to go in Aug.  (1)Do I need a new visa application or fingerprint process or what? When I enter, do I need to show documents other than the visa and the new I-20? Do I need to show emails of last year saying they would defer my admission?  (2) If I come back in Sep 20th, after the expiration of my current F-1 visa (which will expire on Sep 04th)for some personal things, when I come back to the university in America, I need to apply for a new visa, right? but at that time, I will not be able to have my transcript, will that be a deficiency for my visa application? Thank you very much for your reply. Yours
If your visa is still valid, you can use it to enter the U.S. with your new I20 and you do not need to apply for a new one. If I understand correctly, however, you already know that you need to come back to China in September. If that is the case, it sounds like it would be better for you to apply for a new visa now, while you still have time for any
administrative processing. If you come in September for a short visit, your return could be delayed for visa processing.

Answer: It is often more difficult for people who do not live in their home country to qualify for a visa to the U.S. This is because in order to qualify for a visa, you must show that you have a residence abroad that you do not intend to abandon and that you have strong social and economic ties to your home. This is harder when you live in one place, but have a “home” somewhere else. We usually recommend that people apply for a visa where they work and live, but where you apply is your decision. I suggest you look at the U.S. Embassy website for Thailand and China. The documents you prepare should help show the visa officer you do not intend to immigrate to the U.S.

The visa only gives you permission to apply for entry at the port of entry (like an airport). It does not determine how long you can stay in the U.S. The immigration officer at the border will tell you how long you can stay when you enter the country. As long as your visa is still valid on the day you enter the U.S., you should not have any problems.

06-03-2008 02:35:38
Answer: If your husband has traveled to the U.S. before, it would be best if he applied for your daughter (she does not have to come to the Embassy for the interview). He should submit his passport with his old U.S. visa in it, as well as any other passports he has. It would also help the visa officer to see your passports. There is no problem with your daughter traveling to the U.S. with her grandparents; the problem is that in general, the visa officer needs to know that a child’s parents are qualified for a visa before issuing a visa to the child.

Victor Huang: Dear Sonia Urbom, I am a Chinese semiconductor engineer at Samsung Electronics in South Korea. I have been in Korea for almost four years (2-year master courses 2-year work experience). Recently I got admission from Yale MBA program, and had my visa interview at US Embassy in Seoul. However, my visa application was rejected because "the lack of strong tie in China and Korea". Could you please tell me what kind of "strong tie" are you looking for? I sincerely do NOT have any intention to stay in USA after getting my MBA degree, but I don't have any hard evidence  17 to prove my "strong tie" (whatever it means). I am reapplying in Beijing next month. Could you please give me some advice of how to show my "strong tie" in China to visa officer? Thank you.
Dear Victor, I know that the term “strong ties” can be confusing. This just means that according to U.S. visa law, an applicant has to prove that they have social and economic “ties” to a home outside the U.S. that they do not intend to abandon. In other words, you have to show the visa officer that your life outside of the U.S. is such that you would not have any intention of staying illegally in the U.S. “Ties” can refer to family, friends, a career, property, etc. Sometimes it is harder for applicants to qualify for a visa when they are in a third country. Just because you were refused a visa in Seoul does not mean you are not qualified for a visa. Usually, in Beijing, people going to schools like Yale do not have any problems qualifying for a visa.

06-03-2008 02:39:03
Answer: Only the visa officer who interviews you can determine whether or not you are qualified for a visa. You are right, the visa officer might consider you to be an intending immigrant and find you unqualified for a nonimmigrant visa since you have already applied for an immigrant visa. However, it depends on your whole situation. You are welcome to apply. The most important thing is to be truthful on your application and in your visa interview.

chloebebe: Hi, offcier, I am green card holder and my husband is US citizen. My parents want to go to US to look after our children. Is it possible they can get one year travel visa? They are from Bj, and both 62 years old.
Keep in mind that a B1/2 visa is intended for short visits to the U.S. for business or tourism. Some visa officers do not consider taking care of grandchildren for one year to meet the requirements of a B1/2 visa. Your parents need to show that they do not intend to immigrate to the U.S. in order to qualify for the visa. If they do intend to immigrate to the U.S., you should consider applying for an immigrant visa for them. There is lots of information about immigrant visas on the website of our consulate in Guangzhou, which is where we process immigrant visas to the U.S. You can also get information at http://travel.state.gov.

My B-2 visa will expire soon. I want to visit my wife again. Do I apply for an H-4 or a B-2 visa?

06-03-2008 02:50:27
Answer: It is extremely important that you do not stay illegally in the U.S. Your B2 visa was probably valid for one year, but that does not mean that you can stay in the U.S. for one year. Usually, you can stay in the U.S. only for six months, unless the immigration officer at the airport (or other port of entry) wrote in your passport that you can stay longer. Whether you apply for an H4 or B2 is up to you, but the H4 is valid for as long as your petition is valid and it is intended for people who are living in the U.S. The B2 visa is only for short-term tourists. What kind of visa you apply for depends on what you want to do in the U.S. and how long you want to stay there. I suggest you ask your wife's sponsor for assistance. If you cannot find out from the Department of Homeland Security whether or not your change of status to an H4 visa has been approved, you should leave the U.S. before you overstay the amount of time you were allowed to stay in the U.S. If you overstay, you will not be eligible for another visa.

You must have your I20 form before your visa interview. If the I20 form comes late, you can request an expedited appointment.

Hi. My appointment is on June 6 but my I-20 won't arrive until June 7. Can I have interview as scheduled? What certificates should I prepare?

Answer: You must have your I20 before you can come for your appointment. You should send a fax to the Embassy or consulate where you are applying and ask to have your appointment date changed. Please see our website for more information on what students should bring to the interview: http://chinese.usembassychina.org.cn/niv_student.html

Freyja212: There are many students who want to get their visa in Beijing. But the number of interviews are limited. Is there any possibility that the  22 Embassy will arrange more interviews in June? I must have visa inerview before graduation from the University before July indeed. Thank you!
Summer is always our busiest season and unfortunately, the wait for visa appointments is sometimes longer than we would like it to be. Students are always given priority for visa appointments. You can request an expedited appointment by following the directions on our website. Also, hopefully some new appointments will be available in Beijing in July and August.

max2: Dear officer: my parents visited us in the US ten years ago. They stayed with us for two years. I am inviting them to come to visit us again. However, they no longer have the extension approvals from their last visit. What should they do? Also, do they have to have our original I-94 forms? We have been in the US for about 20 years now (we are naturalized citizens), and we couldn't find the forms. Please help.
In general, applicants should always bring copies of their old passports and visa extensions to the interview. You should try contacting the Department of Homeland Security to see if they can provide copies of your parents visa extensions. If not, you should write a letter, in English, explaining when your parents were in the U.S., when they got their extension, etc. And, your parents should be ready to explain this. What is important is to demonstrate that your parents were not in the U.S. illegally. The visa officer will need to know when your parents left the U.S. and returned to China.
